A lease sets out the relationship between a landlord and a tenant and contains basic provisions as to payment of rent and other outgoings, repairing obligations, rights enjoyed by each party and also recites the steps to be taken during rent reviews.
Since the introduction of Section 132 of the Land and Conveyancing Law Reform Act 2009, which banned upward only rent reviews in commercial leases since 28th February 2010, there has been a two-tiered market between legacy leases with upward only rent reviews and more recent leases with flexible terms including break options and upward/downward rent reviews.
Lawrence J Conway Property Services provide advice to both landlords and tenants in relation to general lease renegotiation and on going rent reviews. Where required, we prepare submissions/counter-submissions for arbitration / mediation.
For lease renewal negotiations, in the absence of agreement between the parties, we provide independent expert evidence to the Courts.
